OVERVIEW

Welcome to Self Centred Hair Care. The terms "we", "us" and "our" refer to Self Centred Hair Care. We operate this online store and website, including all related information, content, features, tools, products and services (the "Services"), to provide you with a curated haircare shopping experience.

These Terms and Conditions ("Terms") govern your use of our Services and any purchases you make through our store. They are subject to the laws of New Zealand, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Contract and Commercial Law Act 2017, and the Privacy Act 2020.

By visiting, browsing or purchasing through our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.


SECTION 1 — ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least 18 years of age, or that you are accessing the Services under the supervision of a parent or legal guardian who accepts these Terms on your behalf.

To make a purchase, you may be asked to provide personal information including your name, email address, billing and shipping address, and payment details. You warrant that all information you provide is accurate, current and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must not transfer, sell or assign your account to another person.


SECTION 2 — OUR PRODUCTS

We take care to accurately represent our products. However, product colours and appearance may vary slightly from how they appear on your screen, due to your device settings and display configuration. We do not guarantee that the visual representation of any product will exactly match the physical product received.

Product descriptions are subject to change at any time at our discretion. We reserve the right to limit quantities, discontinue products, or restrict sales to particular regions.

Under the Consumer Guarantees Act 1993, our products carry guarantees that they are of acceptable quality, fit for their stated purpose, match their description, and are free from defects. These statutory guarantees cannot be excluded or limited where you are purchasing as a consumer.


SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. Self Centred Hair Care reserves the right to accept or decline your order for any reason. An order is not accepted until we confirm it and process your payment.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order has been accepted and processing has begun. We will contact you at the email or phone number you provided if we need to cancel or amend your order.

Your purchases are subject to our Refund and Returns Policy, which forms part of these Terms and is consistent with your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

You confirm that purchases are for your own personal or household use and not for commercial resale.


SECTION 4 — PRICES AND BILLING

All prices displayed on our website are in New Zealand Dollars (NZD) and are inclusive of GST (Goods and Services Tax at 15%) unless otherwise stated.

Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed and confirmed in your order confirmation email.

Shipping and handling charges are additional and will be disclosed at checkout before you complete your purchase, in accordance with the Fair Trading Act 1986 requirements for transparent pricing.

You agree to provide accurate, current and complete payment information. You warrant that you are authorised to use the payment method provided, and that charges will be honoured by your financial institution.

We use secure third-party payment processing and do not store your full credit card details.


SECTION 5 — SHIPPING AND DELIVERY

We aim to dispatch orders promptly. All delivery timeframes provided are estimates only and are not guaranteed. We are not liable for delays caused by courier or postal services, customs processing, or events outside our reasonable control.

Risk of loss passes to you when we transfer your order to the carrier. We recommend checking your delivery upon receipt and contacting us promptly if there is any issue.

If goods are lost or damaged in transit, please contact us at contact@selfcentred.co.nz and we will work with you to resolve the matter in accordance with your Consumer Guarantees Act rights.


SECTION 6 — CONSUMER RIGHTS AND RETURNS

6.1 Consumer Guarantees Act 1993

Under the Consumer Guarantees Act 1993 (CGA), you have the right to a remedy if our products:

  • Are not of acceptable quality (not safe, durable, acceptable in finish, or free from minor defects)
  • Do not match their description
  • Are not fit for a particular purpose you made known to us
  • Do not correspond with a sample shown


If a product fails to meet a consumer guarantee, you are entitled to a repair, replacement or refund, depending on whether the failure is minor or major. For a major failure, you may reject the goods and choose a full refund or replacement.

6.2 Fair Trading Act 1986

We comply with the Fair Trading Act 1986 and do not engage in misleading or deceptive conduct. All product claims and descriptions are made in good faith. If you believe a product has been misrepresented, please contact us.

6.3 Change of Mind Returns

We are not required by law to accept returns for change of mind. However, we may, at our discretion, accept returns in their original, unused condition within 14 days of purchase. Please contact us at contact@selfcentred.co.nz to discuss.


SECTION 7 — INTELLECTUAL PROPERTY

All content on our Services, including trademarks, text, images, graphics, product descriptions, and design, is owned by Self Centred Hair Care or its licensors and is protected under New Zealand and international intellectual property law.

You may use our Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify or publicly display any content from our Services without our prior written consent.


SECTION 8 — PRIVACY

You warrant that your Feedback is your own, is accurate, and does not infringe the rights of any third party. You must not submit false or misleading Feedback.

We may remove Feedback that we consider unlawful, offensive, or in breach of these Terms.


SECTION 11 — ERRORS AND INACCURACIES

We endeavour to ensure that all information on our Services is accurate. However, we reserve the right to correct any errors, inaccuracies or omissions at any time, including after an order has been placed. If an error affects your order, we will notify you promptly and offer you the option to proceed at the corrected price or cancel your order for a full refund.


SECTION 12 — PROHIBITED USES

You may only use our Services for lawful purposes. You must not:

  • Use our Services for any unlawful or fraudulent purpose
  • Infringe the intellectual property rights of Self Centred Hair Care or any third party
  • Transmit spam, malware, or harmful content
  • Scrape, harvest or extract data from our Services using automated tools or AI agents
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to our systems


We reserve the right to suspend or terminate your access to our Services at any time if we reasonably believe you have breached these Terms.

No automated agent, bot, web scraper, AI tool, or autonomous software ("Agent") may access or interact with our Services unless it:

  • Identifies itself as an Agent in all HTTP/HTTPS requests via the user agent string in the format: "Agent/[agent name]"
  • Does not mimic human behaviour or circumvent CAPTCHAs
  • Responds truthfully when asked whether it is a human or automated system
  • Complies with any access restrictions or robot exclusion protocols we implement


We may restrict or block Agent access by technical or other means at our discretion.


SECTION 14 — LIMITATION OF LIABILITY

To the fullest extent permitted by New Zealand law, Self Centred Hair Care's liability for any claim arising from your use of our Services is limited to the amount you paid for the relevant product or service.

We exclude liability for indirect, consequential, or loss of profits damages, except where such exclusion is not permitted under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Nothing in these Terms limits or excludes any liability that cannot be excluded or limited by law, including liability under the Consumer Guarantees Act 1993 for failure to comply with a consumer guarantee.


SECTION 15 — DISCLAIMER OF WARRANTIES

Except as required by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, our Services and products are provided "as is" and "as available" without warranties of any kind beyond those required by law.

We do not guarantee that our website will be uninterrupted, error-free or free from viruses or other harmful components.


SECTION 16 — INDEMNIFICATION

You agree to indemnify and hold harmless Self Centred Hair Care, its directors, employees and agents from any claims, losses or damages arising from:

  • Your breach of these Terms
  • Your violation of any applicable law or third-party rights
  • Your use of our Services in a manner not authorised by these Terms


SECTION 17 — GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from or in connection with these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the New Zealand courts.

If a dispute arises, we encourage you to contact us first at contact@selfcentred.co.nz to seek an informal resolution. You also have rights under the Consumer Guarantees Act 1993 to seek a remedy through the Disputes Tribunal or other appropriate New Zealand forum.


SECTION 18 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.


SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Self Centred Hair Care regarding your use of the Services.


SECTION 20 — CHANGES TO THESE TERMS

We reserve the right to update or amend these Terms at any time. Material changes will be communicated to you in accordance with applicable law. The current version of the Terms will always be available on our website.

Your continued use of our Services following any changes constitutes your acceptance of the updated Terms.
